PRELIMINARY PROVISION AND MANDATORY ACKNOWLEDGMENT MECHANISM

By accessing, browsing, interacting with, or remaining on the website www.hafraglobal.com (hereinafter "Site"), the user — whether client, potential client, mere visitor, regulator, debtor, opponent, or any third party — declares, freely, consciously, and irrevocably, that they have read, understood, and fully accept all terms below.

Mere browsing or the act of not immediately leaving the Site constitutes full proof of awareness and agreement with this Policy, serving as an instrument of precaution and prior warning against any future claim of bad faith, misinformation, or inadequate service.

If the user does not agree with any clause, the only appropriate measure is to immediately discontinue access to the Site.

1. EXCLUSIVE PURPOSE OF THE SITE

The Site is strictly informational and institutional in nature, intended to present the services of Hafra Assessoria (Financial Shield), its practice areas, and contact channels.

  • No content on the Site constitutes, by itself, binding legal advice, a service agreement, or a promise of results.
  • The only instance of personalized guidance will occur exclusively during the initial consultation, subject to specialist availability, and does not create any obligation of success, timeline, or guarantee of immediate resolution.
  • It is expressly forbidden to interpret any information as a guarantee of judicial or extrajudicial success, under penalty of the user being held liable for bad faith litigation.

2. ACKNOWLEDGMENT OF LIMITATIONS AND ABSENCE OF MISLEADING PROMISES

The user acknowledges that:

  • Hafra Assessoria does not promise, assure, or take responsibility for specific results, deadlines, or miraculous solutions in judicial, arbitration, or extrajudicial proceedings.
  • Any contrary expectation arises from the user's personal and unilateral judgment and is not opposable to Hafra Assessoria.
  • The practice of law follows the guidelines of the Brazilian Bar Association (OAB), and any advertisement or guarantee of immediate success is prohibited.

3. INTELLECTUAL PROPERTY AND PROHIBITION OF REPRODUCTION

All content on the Site — including texts, images, logos, trademarks, layout, code, videos, and documents — is the exclusive property of Hafra Assessoria or its licensors, protected by copyright and intellectual property laws (Law 9.610/98).

It is strictly prohibited to:

  • Reproduce, copy, distribute, modify, or commercially use any content without prior written authorization.
  • Create deep links or frames that simulate original content without attribution.

Violation will subject the infringer to applicable judicial and extrajudicial measures, including compensation for material and moral damages.

4. USER RESPONSIBILITIES AND DUTIES (CLIENTS, VISITORS, ADVERSARIES, REGULATORS, DEBTORS)

The user expressly undertakes to:

  • Use the Site only for lawful purposes, with any act of sabotage, defamation, harassment, false reporting, scraping, virus transmission, or attempted invasion being prohibited.
  • Provide true, current, and complete information in any contact forms.
  • Not use the Site as an instrument to harass, threaten, persecute, or coerce any member of Hafra Assessoria or third parties.
  • Not file false or reckless complaints based on deliberately distorted interpretations of the Site's content.

Non-compliance authorizes Hafra Assessoria to:

  • Unilaterally block the user's access;
  • File a police report for crimes against honor, slander, defamation, or libel;
  • Use all access records (logs, IPs, dates, times) as judicial or administrative evidence.

5. LIMITATION OF LIABILITY AND RESOLUTIVE PRECAUTION CLAUSE

Hafra Assessoria is not liable for:

  • Decisions or losses arising from information obtained on third-party websites, even if accessible through links on the Site.
  • Damages caused by temporary unavailability, cyber attacks, maintenance, or force majeure events affecting the Site.
  • Content, privacy policies, or practices of external sites (e.g., Google, AWS, document automation providers).
  • Malicious, distorted, or out-of-context interpretations by users seeking harassment or bad faith litigation.

Resolutive precaution clause:
Should the user use this Site as a pretext to file any complaint, report, or action based on deliberate misinterpretation, they are hereby aware that Hafra Assessoria will present this Policy as proof of prior notice, unequivocal awareness, and absence of information defect, requesting dismissal of the proceeding with the user being held liable for bad faith litigation (Art. 80 of the Brazilian Civil Procedure Code) and payment of attorney's fees.

6. EXTERNAL LINKS AND AUTOMATION TOOLS

The Site may contain redirecting links to third-party platforms (Google, AWS, digital signature services, document automation). Hafra Assessoria:

  • Does not control, endorse, or take responsibility for such platforms;
  • Recommends that the user read their respective terms of use and privacy policies before using them;
  • Is not liable for damages arising from the independent use of these tools.

7. CHANGES TO TERMS AND COMMUNICATION

Hafra Assessoria may modify this Policy at any time, without individual notice, and it is the user's responsibility to review it periodically.

The date of the last update (indicated at the top) prevails over previous versions. Continued use of the Site after changes implies automatic acceptance of the new terms.

8. CHOICE OF FORUM AND EXCLUSIVE JURISDICTION

The forum of the domicile of Hafra Assessoria is elected, with express waiver of any other, however privileged, to settle disputes arising from this Policy or the use of the Site.

This clause applies even to potential actions brought by regulators, debtors, adversaries, or any third party alleging harassment or unsatisfactory service, guaranteeing the right to adversarial proceedings and full defense before the chosen jurisdiction.

ACTIVE ACKNOWLEDGMENT SECTION AND ACCEPTANCE RECORD

For purposes of documentary evidence and compliance with the duty of transparency, the Site may provide a complementary mechanism with the following text before the submission of any contact form or inquiry:

"I declare that I have read, understood, and fully accept the Website Usage Policy (including the clauses of limitation of liability, resolutive precaution, and choice of forum). I am aware that this access will be recorded and may be used as evidence in any administrative or judicial proceeding, and I cannot claim lack of knowledge or misinterpretation."

Failure to check this box will prevent the sending of messages, serving as a protective barrier and unequivocal record of mandatory consent.
